Vikings Hall of Fame defensive end Carl Eller, who was taken immediately into custody last week after a judge imposed a 60-day prison sentence upon him, is going to ask to be released from jail while he appeals the decision. The hearing is scheduled for Tuesday afternoon, according to the Minneapolis Star Tribune. It’s a smart move, given that the 60 days likely would be fully served before the appeal process otherwise works itself out. The sentence resulted from a conviction via a bench trial (i.e., trial by judge not jury) on gross misdemeanors for assault and refusal to submit to chemical testing. He allegedly/actually roughed up a couple of police officers in an April 2008, and in the process absorbed a Taser shot -- and still kept coming. The lingering good news for Eller? The incident occurred a month after coming off probation for a 2006 drunk driving incident.
