In a search warrant affidavit filed by law enforcement in the investigation into sexual assault allegations against former 49ers defensive lineman Ray McDonald, it is alleged that 49ers linebacker Aldon Smith was at McDonald’s house drinking vodka with his former teammate.
Smith remains on probation for a previous DUI charge, which bars him from drinking alcohol and driving, and his agent responded to the release of the court documents by saying that Smith had an alcohol-free visit with McDonald. On Tuesday, Smith issued the same denial.
“As far as it’s concerned, I was over at Ray’s house for close to an hour,” Smith said, via CSNBayArea.com. “I didn’t drink one thing. And as far as it goes, relating to that, I have nothing else to say. It’s not my issue or my problem.”
Smith said he is tested regularly for alcohol use -- “Enough for me to pass the test” was his response to a question about how often -- and has said in the past that he has remained sober since a stint in rehab in 2013 came to an end. The 49ers have said they’re aware of the allegations regarding Smith and are looking into them.
